The topic of the EARR 2020 is legal disputes concerning “Protection of Bats and International Trade Measures.”
The Federal States of Alducra and the Republic of Runbeti, are neighboring sovereign states located continent of Architerpo. Bats are ecologically important to the countries on Architerpo. About 20 years ago, agave farmers in both countries turned to using clones from the mother plant. Concerned about the impacts on the bat, Alducra passed domestic legislation in January 2015 requiring all agave farmers in Alducra to use bat-safe farming practices.
In April 2015, Government of Runbeti announced a new program which consists four phases that would provide substantial government subsidies. However, because the first phase construction’s part of the property is a known migration route, and critical feeding areas for the bats, the Chiroptera Crusaders repeatedly expressed concerned. The Government of Runbeti agreed to let them monitor the area after construction was complete. During 2017 and 2018, the Chiroptera Crusaders found several dead bats and reported to the Government of the Alducra.
On January 2019 the Government of the Federal States of Alducra delivered the diplomatic note to Runbeti, requesting to shut down the wind farm and implement appropriate mitigation measures. The Government of Runbeti sent a diplomatic note that declines Alducra’s request. After, Chiroptera Crusaders would no longer be allowed to access the wind farm for monitoring.
In November 2019, Alducra passed a statute to institute certain requirements related to the import and sale of tapagium in Alducra. The Government of Runbeti sent a diplomatic note that the statute is protectionist and violate the ARTA, Therefore, requesting repeal the trade restrictions. The Government of Alducra declines Runbeti’s request to repeal the statute and claims justification under the ARTA exceptions.
Further negotiations between Alducra and Runbeti failed to resolve the dispute, and the two countries entered into a Special Agreement to institute proceedings in the International Court of Justice (ICJ).

2020년 제9회 스텟슨 국제모의재판 동아시아 경연대회에서는 “박쥐 보호와 국제 무역 조치의 갈등” 에 관련한 법적 분쟁을 다룹니다.
알두크라 연방과 룬베티 공화국은 아르키테르포 대륙에 위치한 인접국가입니다. 알두크라와 룬베티를 포함하여 아르키테르포 국가들에게 박쥐는 생태학적으로 중요한 지표종입니다. 약 20년 전부터 양국의 용설란 재배 농민들은 클론을 사용한 재배법으로 전환하였고, 이에 따라 알두크라는 2015년 1월 국내의 모든 용설란 재배 농민들이 박쥐에 안전한 농법을 준수하도록 하는 국내법을 통과시켰습니다.
2015년 4월, 룬베티 정부는 상당한 규모의 정부 보조금이 지급되는 4단계의 건설과정으로 구성된 프로젝트를 발표하였습니다. 그러나 1단계의 건설예정 토지가 박쥐의 주요 식량공급 및 보금자리 영역을 포함하여 박쥐십자군에게 많은 우려를 받았습니다. 룬베티 정부는 프로젝트 1단계의 착공을 전후하여 그들이 완공 지역을 모니터하는 것에는 합의하였습니다. 박쥐십자군은 2017년과 2018년에 걸쳐 풍력발전소를 모니터하였고, 다수의 박쥐 시체를 발견하자 알두크라 정부에게 보고하였습니다.
2019년 1월 알두크라는 국제협약 위반에 따른 풍력발전소 가동 중지 및 경감 조치 시행을 요구하는 외교문서를 전달하였습니다. 룬베티는 위반사실을 부정하며 알두크라 정부의 요청 거절 및 프로젝트의 다음 단계건설의 진행을 통보하는 답변서를 전달하였습니다. 그 이후 박쥐십자군의 모니터링도 불가하게 되었습니다.
2019년 11월, 알두크라는 타파기움 생산에 있어 박쥐에 안전한 농법을 장려를 위하여 알두크라에서 판매 및 수입된 모든 타파기움에 대해 적용되는 세금 및 표시 의무를 부과하는 법안을 통과시켰습니다. 같은 해 12월, 룬베티는 위 법률은 보호주의적 이며 ARTA의 위반이므로 무역 제한의 철폐 요청하는 외교문서를 전달하였습니다. 알두크라는 ARTA의 예외 조항에 따른 정당함을 주장하며 법 폐지 요청을 거절하는 답변서를 전달하였습니다.
알두크라와 런베티는 위 문제들에 관하여 여러 차례 협상을 하였으나, 결국 해결에 이르지 못하여, 양국은 국제사법재판소에서의 절차를 진행하기 위해 특별 협정을 체결하였습니다.
